1. Introduction
These Terms & Conditions (“Terms”) govern your access to and use of:
- The Tasty Passport website at https://www.tastypassport.online; and
- Our web app and related services that help you discover venues, claim deals and unlock rewards
(together, the “Service”).
The Service is operated by STUDiO 17 LTD (“Tasty Passport”, “we”, “us” or “our”). You can contact us at info@tastypassport.online.
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.
Your use of the Service is also subject to our Privacy Policy, which explains how we process your personal data under the General Data Protection Regulation (EU) 2016/679 (“GDPR”) and other applicable laws. Please read it carefully.
2. Who may use the Service
2.1 Age requirement (18+)
The Service is intended only for users who are at least 18 years old.
By accessing or using the Service, you represent and warrant that:
- You are at least 18 years of age; and
- Any information you provide to us is true, accurate and complete.
We do not knowingly allow individuals under 18 to use the Service or to create an account.
2.2 If we discover someone under 18 is using the Service
If we become aware, or have reasonable grounds to believe, that someone under 18 is using the Service:
- We may suspend or terminate their access to the Service; and
- We will take reasonable steps to delete their account and associated personal data, except where we need to keep certain information to comply with legal obligations (for example, to demonstrate how we handled the situation).
If you believe that someone under 18 is using Tasty Passport, please contact us at info@tastypassport.online with enough information to help us investigate (for example, the email address or account identifier). We will review the situation and take appropriate action.
3. Description of the Service
Tasty Passport is a web-based discovery and loyalty platform that:
- Helps food lovers find curated venues (cafés, restaurants, bars, etc.) and access discounts and rewards; and
- Provides venues with tools to run welcome offers and loyalty ladders, track visits and engagement, and view anonymised or pseudonymised performance data.
Important points:
- We are not a restaurant or venue. We do not prepare or serve food or drinks.
- We are not a payment processor. You pay the venue directly; we do not charge you for your meal or handle your payment to the venue.
- Deals and rewards are offered by the participating venues, subject to their own conditions (for example, minimum spend, exclusions, time windows).
- Availability of venues, deals and rewards may change at any time.
4. Your account and security
We may allow you to create an account or access the Service via a unique link, code or login method.
You are responsible for:
- Maintaining the confidentiality of any login details, codes or access links associated with your account;
- All activities that occur under your account; and
- Notifying us promptly if you suspect unauthorised access or use.
We reserve the right to refuse registration, suspend or terminate accounts at our discretion (see Section 11).
5. Use of the Service
You agree to use the Service only for lawful purposes and in accordance with these Terms. In particular, you must not:
- Attempt to game or abuse the rewards system (for example, falsifying visits, scanning QR codes without genuinely visiting the venue, using bots or fake accounts);
- Interfere with or disrupt the Service, servers or networks;
- Access or attempt to access parts of the Service you are not authorised to use;
- Reverse engineer, decompile or attempt to extract source code from the Service;
- Use the Service to transmit any harmful, fraudulent, defamatory, offensive or unlawful content;
- Use the Service in a way that violates any applicable laws or regulations, or that infringes the rights of others (including privacy and intellectual property rights).
We may monitor general usage patterns and take reasonable steps to detect and prevent abuse.
6. Deals, rewards and venue responsibilities
6.1 Deals and loyalty ladders
- When you claim or redeem a deal through Tasty Passport, you are entering into a direct relationship with the venue, not with Tasty Passport.
- Each deal or reward may be subject to conditions set by the venue (for example, minimum spend, dine-in only, excluded items, time/day restrictions, one per table).
- Venues may modify, pause or discontinue specific deals, rewards or participation in Tasty Passport at any time.
We do not guarantee:
- That any particular venue, deal or reward will be available when you arrive; or
- That prices, menus or descriptions on the Service will always be accurate, as these are controlled by the venues.
6.2 Venue responsibilities
Venues are solely responsible for:
- Setting and honouring their own offers, discounts and rewards;
- The quality, safety and legality of food, drinks and service;
- Compliance with all applicable laws and regulations (including health and safety, pricing, employment, licensing and consumer protection).
Tasty Passport is not a party to any transaction between you and a venue and has no control over their operations.
If you have an issue with a venue (for example, service quality or bill disputes), you should first address it with the venue directly. You can also contact us so we can investigate from a platform perspective and decide whether to take action (for example, reviewing their participation in Tasty Passport).
7. Venue / business accounts
If you use the Service as or on behalf of a venue or other business:
- You represent and warrant that you have authority to bind that venue or business to these Terms;
- You agree to provide accurate venue information (name, address, opening hours, offers, descriptions, photos, etc.) and keep it up to date;
- You are responsible for any discounts or rewards you configure, and for ensuring your staff understand how to validate and honour them.
We may provide you with access to a dashboard or tools containing performance data (for example, visits, redemptions, ladder progression). You must use this data solely for internal business purposes and in compliance with applicable data protection laws and our Privacy Policy.
8. Intellectual property
Unless otherwise stated, Tasty Passport owns or licenses all rights, title and interest in and to the Service, including:
- The Tasty Passport name, logo, branding and visual identity;
- The design, layout, look and feel of the Site and web app;
- The underlying software, databases and content (excluding content provided by venues or users).
We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for your personal (or, for venues, internal business) use, in accordance with these Terms.
You may not:
- Copy, modify, distribute, sell, lease or sublicense any part of the Service without our prior written permission; or
- Use our trademarks, logos or branding without our prior written permission.
9. User content and feedback
If you submit content or feedback to us (for example: suggestions, comments, testimonials, logos or photos you provide as a venue), you grant Tasty Passport a worldwide, non-exclusive, royalty-free licence to use, reproduce, display, adapt and distribute that content:
- For operating, maintaining and improving the Service; and
- For marketing and promotional purposes, where appropriate.
You promise that:
- You have the necessary rights and permissions to grant this licence; and
- Your content does not infringe the rights of others or violate any laws.
You can request that we stop using certain content for future marketing by contacting us, although this may not affect materials already created or distributed.
10. Privacy
Your use of the Service is also governed by our Privacy Policy, which explains in more detail:
- What personal data we collect;
- For what purposes and on what legal bases under GDPR (for example, performance of a contract for core features, legitimate interests for certain analytics, and consent for marketing where required);
- How long we keep your data;
- With whom we share it (for example, service providers and venues, where applicable); and
- Your rights under GDPR (such as access, rectification, erasure, restriction, objection and data portability), and how you can exercise them.
By using the Service, you acknowledge that we will process your personal data in accordance with the Privacy Policy in place at the time of your use.
11. Suspension and termination
We may suspend or terminate your access to the Service (including any account you hold) at any time, without prior notice, if we reasonably believe that:
- You have violated these Terms or any applicable law;
- Your use of the Service risks harm to the Service, to other users, to venues or to us; or
- We are required to do so by law or by a competent authority.
Where appropriate, we will let you know why we have taken such action and, where possible, give you an opportunity to respond.
You may stop using the Service at any time. If you wish to delete your account, you can contact us at info@tastypassport.online.
We will handle your request in line with our Privacy Policy and applicable data protection laws (including GDPR), which may mean we retain certain information for a limited period where we have a legal obligation or legitimate interest to do so.
12. Disclaimers
The Service is provided on an “as is” and “as available” basis.
To the fullest extent permitted by law, we do not make any warranties or representations that:
- The Service will be uninterrupted, secure or error-free;
- All information (including venue details, menus, prices and availability) will always be accurate, complete or up to date; or
- Any particular venue, deal or reward will meet your expectations or be available at a specific time.
We specifically disclaim responsibility for:
- The quality, safety, legality or fitness for purpose of any food, drinks or services provided by venues;
- Any act or omission of venues or their staff; and
- Third-party websites or services linked from the Service.
Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.
13. Limitation of liability
To the maximum extent permitted by law:
- Tasty Passport and its founders, employees, contractors and partners shall not be liable for any indirect, incidental, consequential, special or punitive damages, or any loss of profits, revenue, data or goodwill, arising out of or relating to your use of (or inability to use) the Service; and
-
Our total aggregate liability for any claims arising out of or relating to the Service or these Terms shall be limited to the greater of:
- €100; or
- The total amount (if any) you have paid directly to Tasty Passport for the Service in the 12 months before the event giving rise to the claim.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law (for example, liability for death or personal injury caused by negligence, or for fraud). Your mandatory statutory rights as a consumer are not affected.
14. Changes to the Service and to these Terms
We may modify or discontinue parts of the Service at any time (for example, adding new features or retiring old ones).
We may also update these Terms from time to time. When we do:
- We will update the “Last updated” date at the top; and
- For material changes, we may provide additional notice (for example, by email or an in-app message).
If you continue to use the Service after changes take effect, you are deemed to have accepted the updated Terms.
15. Governing law and jurisdiction
These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of Cyprus, without regard to conflict-of-law principles.
You agree that the courts of Cyprus shall have exclusive jurisdiction to settle any such dispute or claim, subject to any mandatory consumer protection rules that give you additional rights in your country of residence.
